Amendments to the Export Control Order 2008

Find out what changes have been made

Colleagues are encouraged to review their projects and that of their visitors and students as there have been changes made to the UK Strategic Export Control List (especially if previously a self-assessment has concluded that they were not controlled because it didn’t hit the threshold described or wasn't listed).

What changes have been made?

The UK government has amended the Export Control Order 2008 and the retained Council Regulation (EC) No 428/2009. This update came into force on 13 July 2023. The updated list reflects changes administered by two regimes the Wassenaar Arrangement and the Australia Group to which the UK is signed to.

The changes include:

  • four new entries for toxins namely brevetoxins, gonyautoxins, nodularins and palytoxin; removal of certain entries and other editorial changes under entries 1C351, 1C353, 1C354 and 2B352.
  • a new entry in category 8 - Marine: Permanent magnet electric propulsion motors specially designed for submersible vehicles, having a power output exceeding 0.1 MW are now controlled under entry code 8A002.o.4. Note: 8A002.o.4. also includes rim-driven propulsion systems.
  • a new entry in categories 9 - Aerospace and propulsion: technology required” for the “development” of any of the following components or systems, specially designed for aero gas turbine engines to enable “aircraft” to cruise at Mach 1 or greater for more than 30 minutes. The following will now be controlled under 9E003.k: Propulsion inlet systems; Propulsion exhaust systems; ‘Reheat systems’; ‘Active thermal management systems’ to condition fluids used to lubricate or cool ‘engine rotor supports’; Oil-free ‘engine rotor supports’; or Systems to remove heat from ‘compression system’ core gas path flow.
  • amendments to certain thresholds (parameters) in category 4 - computers (view entries 4D001.b.1., 4E001.b.1.,)
  • amendments to certain thresholds (parameters) in category 6 - sensors and lasers (view entries 6A005.b.3.a.2., 6A005.d.1.a.1., 6A005.d.1.a.1., 6A005.d.1.a.2)
  • textual amendments to several technical notes, corrections to minor drafting errors and inconsistencies.

Actions for researchers and principal investigators

If you have previously assessed your, or your visitor’s or students’, projects/samples/equipment and concluded that it was not coded, it is your responsibility to look again in the new list, in case the new changes affect the entry code that your project previously did not met threshold to be considered controlled, or if it could now fall under one of the new entries.
